Poll: Should A 15 Year Old Girl Face Child Porn Charges For Sending Pictures Of Herself?

Oh my, what a doozie this case is. A 15 year old girl took naked pictures of herself, and sent them to classmates. She has been arrested and is being charged with felony child pornography.

Central Ohio authorities have filed felony charges against a 15-year-old girl accused of taking nude cell phone photos of herself and sending them to high school classmates.

Police say the Newark Licking Valley student was arrested Friday and held over the weekend. On Monday, she entered denials to juvenile charges of illegal use of a minor in nudity-oriented material and possession of criminal tools.

A spokeswoman for the Ohio attorney general’s office says an adult convicted of the child pornography charge would have to register as a sexual offender, but a judge would have flexibility on the matter with a convicted juvenile.

A prosecutor says Licking County authorities also considering charges for students who received the photos.

    Yes, she should recieve the charges. Those pictures could have floated out there online for years, getting into the hands of other child porn predators. By the definition of the law she is guilty as it has no limitations on the identity of the subject, just the age. It is the severity of the law which reduces the numbers of teens who would atempt it. If the DA determines that the recipients in no way enticed the action, shared or made copies of the images then they should forgo charges on them. The judge can modify the sentence so she doesn’t recieve a permanent sex offender listing, but I agree to time for the crime. Children have access to these gadgets at such young ages yet they show questionable responsibility. In less than a year this girl would be behind the wheel. What if she thought speeding through a school zone was something fun to do? I had a friend who was riding inthe car of a 17 yr old who did… he mowed down three friends.

    Remo! What’s up? Excellent points on the case. Unfortunately, government can’t draw a distinction between whether or not a 15 year old is old enough to make their own decisions.

    This amounts to saying that the 15-yr-old in question is a filthy depraved pervert in need of legal sanctioning *and* a sweet innocent little girl in need of protection. And a dessert topping and a floor wax too, I suppose.

    this is a very interesting case

    under federal law 18USC2256 it is NOT illegal to take nude pics of a minor (under 18) provided there is no sexual activity (real or implied) in the photos.

    most of us would agree, this is reasonable. we should not charge parents with a crime for taking pics of a newborn baby’s first bath, if a doctor has photos of a topless girl who needs a medical proceedure (breast reduction, or heart surgery) or an art gallery with paintings/photo’s of nudity on the wall.. (some 17th century art includes nudity of people that appear to be under 18)

    it would be one thing if an adult took the pics without the girl’s consent and sold them online as sexual exploitation but if the girl took the pics, how can she exploit herself? were the photo’s sent only to a boyfriend or a few friend.. if they made them public without the girl’s permission -this would be a crime without a model release being signed ans since the girl is a minor co-signed by a parent

    what is the purpose of the law & what should it be?

    to protect minor’s from being exploited either by others or by herself through her inexperience as a minor.. nudity isn’t pornography ..therefore stating that parents would need to be be aware photo’s were taken and co-sign a model release I think is reasonable. unlike europe most american’s seem to get really upset over this nudity issue.. I think we need to lighten up a bit on this

    kristy….I agree 100%…also I dont think this is the only teenage girl or guy
    that takes pics of them self for there friend/friends. If they put charges on all these teenagers, the prisons would be full of teenagers and they would have to let the real criminals free. as far as the prosecutor not sure if they are going to charge the kids that recieved these pics…come on who ever they were
    had a cell phone that had a pic attachment from a girl that took pics of her self
    and sent them…. did she ask them if they wanted the pics? NO she just sent them. any one that thinks any of these kids are criminals or broke some law
    should be ashamed of them self. There has to be a point were we all say is this what the founders really intended? are some of these laws being pushed to the max by prosecutors,just for money.lawyers/probation/court fees/jails/law officials/court officials/and here is a REAL GOOD ONE “RESTITUTION” this is all tied in together. be carefull what you wish for on to others,I’m sure EVERYONE
    on here has brokeing some kind of law,even if they didnt know they did,thats punishable buy incarceration!

    It should be noted that “The girl was accused of sending out photographs of herself in various states of undress and performing a variety of sexual acts. She sent them to people she met in chat rooms on the Internet.” She did break Federal Law 18USC2256. Likely she sent the picture to police officer, using an alias, who monitors such chat rooms to protect kids from predators.
